日本においても2009年8月1日より国際売買契約に関する国連条約（CISG）が発効したため、CISGが適用される事案については、ほとんどの場合において準拠法の決定が不要となる。ただしCISGが適用されるような国際売買契約の事案においても、CISGが規定しない事項、あるいは適用除外とされた事項についても解決しなければならない場合には、準拠法の決定が必要となる。したがってウィーン売買条約と国際私法の関係を検討することが本研究の目的である。
